Who are we, and what is this policy about?

You’re here because you care about your privacy, especially when it comes to sharing your personal thoughts and experiences with our product. As the creators of Looki, privacy is of the utmost importance to us.

Looki Tech Limited ("Looki", "we", "us") is a company building personalization products, starting with Looki hardware product, a multimodal AI wearable which can be purchased on our online market (https://www.looki.ai), and the associated app Looki App. Looki App is an AI-powered personal intelligence app that helps people document life, analyze information, offer creative insights and brainstorm on topics, by keeping track of surrounding people, objects, places and dates. Looki ingests videos, audios, images, and other medias, and use this information to produce relevant, helpful and inspirational contents. Looki App ingests notes, images, audio, files, links, and uses this information to productively brainstorm and proactively surface information that meets your specific tastes and needs.

Before using our services, please read this Privacy Policy carefully. By accessing or using our services, you acknowledge that you have read, understood, and agreed to the terms of this Privacy Policy. By ticking or clicking the checkbox “Agree with this Privacy Policy” on relevant pages, you acknowledge and confirm your consent to our processing of your personal information for the purposes described herein and in accordance with this Privacy Policy.

Our Privacy Principles

This Privacy Policy helps you understand what personal information we collect, how we use and disclose it, and what choices you have about it.

Our commitment to your privacy is a fundamental part of our mission to provide a space where you can feel free to share your personal information without worry that your information will be used in a way that contradicts your interests.

Knowing that you place a lot of trust in us to do so, we wanted to transparently share with you our guiding principles for our privacy practices:

  • You control whether to enable features that collect and process your data, and can manage or delete your data at any time. You decide what information you allow us to access and use, and you may exercise your privacy rights in relation to your personal information.
  • We will delete your personal information if you ask us to. We store the content you upload to our servers, which may include your personal information, but we will delete this information upon your request.
  • We do not use your personal content to train general AI models or share it with other users. We only use the content you upload to provide our services back to you.
  • We do not advertise or market to you using the content you upload. We monetize our services by offering subscriptions to our users, not by selling your content.

Personal Information We Collect

We have considered a number of alternatives and believe that collecting your personal information is the only way for us to provide you with a truly personalized computing experience that is convenient, safe, and reliable. We may collect information about you directly from you, from third parties, and automatically through your use of our services.

Here we set out a major list of the information we will collect:

  • Account information. When you create account through the online market or Looki App, you will need to provide us with information such as your email address and verification code to administer your account.
  • Product and service information. When you browse, select, purchase, register, activate, return product and services through the online market or Looki App, you may provide us with order-related and service-related information.
  • Contact information. When you place an order with us, sign up for notifications or updates, or contact us for customer service, you may provide us with your contact information including your email address, name, shipping address, phone number, and billing address.
  • Communications. When you interact with us, we may collect your communications with us, including the time, topic and the content of your communications.
  • Payment information. When you place an order with us or engage in financial transactions by using our products or services, you may provide us with your payment information, including your payment method, credit card information, discount code, and payment amount.
  • Content you provide or is generated through your use of the Services. We collect content that you choose to upload or provide through our products or services, including messages, images, videos, audio clips, and files. In addition, when you enable certain features, the device may automatically capture and upload limited, compressed data to provide functionality. This data is collected only when such features are activated by you and may include visual, audio, or contextual signals. Please note that, if the content you provide contains information about others, you should inform them about this Privacy Policy and obtain any required or appropriate consent from such persons as well as other applicable legal basis prior to providing such content to us.
  • Geolocation information. When you activate the hardware products, or use the map function of Looki App, you may provide us with your geolocation information. Please be aware that you may provide your geolocation information to third party map service providers to receive location-based services.
  • Usage information. When you experience the features of Looki App, you may provide us with your usage information, such as information about how you use the app and interact with us, including metadata associated with any content you upload to the app or otherwise submit to us.
  • Google APIs. We use Google’s login API services to connect with your Google account.
  • Other personal information we may collect from you from time to time as necessary for our business operations, service updates, feature changes, or other purposes described in this Privacy Policy.

Cookies and Similar Technologies

We use cookies and similar technologies to operate, secure, and improve our Services. Cookies are small text files stored by a web browser on your device. They are generally used in connection with our website.

For our mobile applications and other device-based Services, we may use similar technologies, such as SDKs, local storage, and device identifiers, which perform similar functions but are not browser cookies. These technologies may collect information such as device type, operating system, browser type, IP address, unique identifiers, language settings, carrier, and general location information.

How We Use Personal Information

We use personal information for several purposes, with the primary aim of providing and improving a world-class product. More specifically, we use personal information for the following purposes:

  • To provide our services. We use personal information to operate, maintain, and provide you with our services, including facilitating account registration, providing fundamental services as well as AI-related services. Without such consent, some or all features of our services may not function properly or may be unavailable. Except where consent is required, we use personal information to fulfil our contractual obligations under our terms of service. Where we seek your consent, you may withdraw your consent at any time.
  • To communicate about our services. It is in our legitimate business interests to use personal information to respond to your requests, provide customer support, and communicate with you about our services, including by sending announcements, updates, security alerts and support and administrative messages.
  • To improve, monitor, personalize, and protect our services. It is in our legitimate business interests to improve and keep our services safe for our users, which includes:
    • understanding your needs and interests, and personalizing your experience with the services and our communications. Nevertheless, we do not carry out personalized marketing on the online market or the Looki App.
    • troubleshooting, testing and research and keeping the services secure; and
    • investigating and protecting against fraudulent, harmful, unauthorized or illegal activity.
  • For research and development. We may use personal information for research and development purposes in our legitimate business interests, including analyzing and improving the services and our business. As part of these activities, we may create or use aggregated, de-identified or other anonymized data from personal information we collect. We make personal information into anonymized data by removing information that makes the data personally identifiable to you. We may use this anonymized data and share it with third parties for our lawful business purposes, including analyzing and improving the services and promoting our business.
  • For compliance and protection. We may use personal information to comply with legal obligations, and to defend us against legal claims or disputes, including to:
    • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
    • audit our internal processes for compliance with legal and contractual requirements and internal policies;
    • enforce the terms and conditions that govern the services;

Where permitted by law, we may process your personal information without your consent in accordance with applicable data protection regulations, for example, to perform a contract with you, protect public or vital interests, comply with legal obligations, or process personal information that has been lawfully disclosed.

How We Disclose Personal Information

We do not sell personal information. We may disclose personal information as described in Personal Information We Collect section above to:

  • Parent company and affiliates, who may support the operations, and administration of our services.
  • Service providers, that provide services on our behalf or help us operate our services or our business (such as transactions, location, hosting, communications, data and cyber security, fraud and bias detection, investigation and prevention, web and mobile analytics, and email and communication distribution and monitoring).
  • Third party AI providers, that we use to help support our AI-powered assistant. We require these providers to use your information only for the purpose of facilitating our AI-powered tool, and we do not allow these providers to train their AI models using your personal information.
  • Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
  • Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate to protect us or others against fraudulent, abusive, or unlawful activities, to safeguard the security or integrity of our services, and for the compliance and protection purposes described above.
  • Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Looki or our affiliates (including, in connection with bankruptcy or similar proceedings).

Privacy Rights and Choices

We respect your rights to your personal information and will protect them in accordance with applicable data protection laws.

If you wish to access, correct, update, or delete your personal information, or to exercise any other statutory rights related to your personal information (e.g., withdraw consent to our collection and processing of your personal information, or, subject to statutory conditions, require us to transfer your personal information to a third party designated by you, or restrict our processing of your personal information, etc.), you may manage your personal information settings through online market or Looki App or you may contact us using the contact details provided under the section “How to Contact Us” below. 

We will respond to all requests we receive from individuals seeking to exercise their personal information rights in accordance with applicable data protection laws and regulations. We may ask for additional information from you to help us confirm your identity. The additional information we may request will depend on the nature of your request and the type of personal information to which it relates. In certain circumstances, we may also be legally required to obtain a signed declaration from you, made under penalty of perjury, confirming that you are the individual to whom the request relates. Where we have reason to believe that fraudulent or malicious activity has occurred on or through your account, we may defer acting on your request until we are able to verify your identity and confirm the legitimacy of the request. Depending on where you reside, you may be entitled to empower an authorized agent to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.

In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, you may submit a complaint by contacting us as provided in the “How to Contact Us” section below. Depending on where you reside, such as if you reside in the European Economic Area or United Kingdom, you may have the right to complain to a data protection regulator where you live or work, or where you feel a violation has occurred.

Data Storage and International Data Transfers

Your personal information is primarily stored and processed on secure servers located on the Amazon Web Service (AWS) in Oregon, United States.

We may also transfer personal information to our affiliates and service providers in the United States and other jurisdictions. When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for personal information and we will comply with applicable data protection laws, in particular by relying on an EU Commission or UK government adequacy decision or on contractual protections for the transfer of personal information. How We Retain Personal Information

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws and regulatory obligations or until you withdraw your consent (where applicable).

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements. Upon the expiration of the retention period, we will delete or anonymize your personal information as required by applicable laws.

Our services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions. This Privacy Policy does not apply to such third-party sites or services.

Data Security

Ensuring the security of your data is our utmost priority. All data transmitted between you and our services is secured using strong encryption protocols both at rest and in transit. Users acknowledge and agree that all video content and related rights belong solely to the user. The user is responsible for ensuring that any content captured or uploaded through the device has obtained all necessary legal authorizations and explicit consent, and that such use complies with all applicable laws relating to privacy, recording, anti-surveillance, and similar regulations. The device must not be used in high-risk or sensitive locations, including but not limited to dressing rooms, restrooms, medical facilities, government agencies, military bases, or critical infrastructure. In the event that any unlawful recording, uploading, or sharing results in harm to the rights of third parties, the user shall bear full liability and compensate the company for any losses incurred.

Children

Our services are not intended for use by children under 16 years of age. If we learn that we have collected personal information through our services from a child under 16 without the consent of the child’s parent or guardian as required by law, we will delete it.

Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you.
